Litigation 

Our litigation practice is active and dynamic. Over the years, we have achieved outstanding results in disputes conducted before ordinary and special courts, and before the Courts of Appeals and the Supreme Court of Chile, as well as before administrative bodies. 

Ugarte & Correa’s experience covers disputes framed in a broad spectrum of topics and activities, including commercial litigation (mining, construction, corporate disputes, energy, concessions and infrastructure, property rights, among others), regulated markets (filing of claims before authorities and disputes related to regulated activities), insolvency, inheritance matters, tort liability, enforcement of awards, antitrust disputes, among others. Antitrust

Ugarte & Correa has positioned itself as a key player in antitrust matters. We have represented national and international clients in some of the most emblematic antitrust cases in the history of Chile, including litigation related to cases of collusion, unfair competition and abuse of a dominant position, as well as merger control and application of the leniency program before the Chilean antitrust authority. 

In litigation matters, Ugarte & Correa won the most important collusion case in the history of Chile and, both in this way and through the leniency program, has saved its clients millions of dollars in fines that the authority has sought to apply to them for alleged anti-competitive practices. 

We cover all the diverse matters that make up the practice of competition, including the control of concentration operations, defense in investigations by the antitrust authority, class actions and damages, unfair competition, preventive advice and compliance.
